Pap, when we broke, you had made the argument that under a 1952 statute, and I guess then

amended by a court ruling or statute in 1990, that Donald Trump was not quite there in terms

of being unconstitutional in the application of this executive order, but that he could

be in danger of it.

Let me ask you about this aspect.

We have these seven countries.

They're majority Muslim countries.

Some people are making the argument that if this was a Muslim ban you would see it applied

to all countries with Muslims.

If this was discriminatory towards Muslims, you would see that everywhere, but we don't

hear that frame of argument when we talk about disenfranchising black people when they go

into vote.

The courts have found many times that voting restrictions have been set up to depress black

vote and suppress black vote.

That doesn't mean that they have to suppress every single black vote, right?

No.

I'm going to make an early call.

I love doing this.

The early call is that Trump is going to prevail on this in some form or fashion.

What's going to happen, Sam, is you're going to have courts probably in the fifth circuit,

Texas, Louisiana.

The circuit court is ultimately going to get it.

They're going to rule that what Trump has done is completely fine.

You're going to have a court in Boston.

That's circuit is going to rule, no, it's not.

They're going to get an emergency hearing up to the United States.

If they do that too quickly, if that happens too quickly, they're actually causing harm

to what they're trying to accomplish because they will not win on race.

They will not win on race and religion as it is right now because right now his argument

is very clear.

It's a stop gap measure.

It's extraordinary, yes.

It's discretionary, absolutely.

It's a stop gap measure simply to continue looking at this thing that he wants to call

extreme vetting.

It's going to be an incomplete case at that point, incomplete file.

What the next stage is going to be is it's going to have to be the test.

The test is the way that this took place and what happened afterwards.

Is it clearly discriminatory against race and religion?

Even if it is, you need to understand even if it is, somebody has to say that they did

this without showing any overt action on the people that they kept out.

You're not going to have the Homeland Security do that.

They're going to come up with some subjective reason why there's some overt act that this

individual or that individual engaged in.

It may be as simple as connecting on a computer.

They're going to say that reaches the standard for the 1990 test, and that's where the argument

is going to take place.

Sam, it's one of these things.

It's an epidemic within the media right now.

The first thing, I tried to read Huffington Post.

God almighty, I almost can't read it any more.

It's like a bunch of college sophomores are writing for them now.

As you look at it, it's all fear and loathing.

It's all these extreme statements.

Race and religion, it's going to fall without any analysis.

I think on something like this we have to analyze it, if we want to really protect ourselves

rather than fools rushing in and saying with this wide swath, 'This is not going ...' The

guy can prevail here, man.

I'm telling you, he can prevail unless it's done properly.

To what extent is there in the creation of this, picking out of these seven countries

... To what extent is something like Rudy Guiliani saying that this would start it off

as a Muslim ban, and they wanted to try to fit it into a legal framework?

To what extent does that aspect or does Donald Trump going onto the Christian Broadcast Network

a couple days before the release of the ban saying, 'We're going to make it easier for

Christians even from these countries to come in?'

Your point is intent.

Does the intent behind the action, the executive action, is that relevant?

Absolutely, it's relevant.

That's one of the factors that the court takes in place, into hand.

There's another thing people are totally missing.

A character in Syria has no constitutional rights in the United States unless they're

US citizens.

They don't get the advantage of- The obligations under the First Amendment

are not implicated by the person who's kept out.

It's implicated by the actions by the US government.

The US government cannot choose winners and losers based upon the religion of people coming

in, can they?

They cannot do that, but what I'm trying to say, that's got to apply to people that are

US citizens.

That's where the test is.

Here's the point I'm trying to make.

The point is that this right now to argue that this is all going to fail, that Trump's

effort is all going to fail based on race and religion is completely a fraudulent argument.

To rely on 1965, the Immigration Nationality Act of 1965 is a mistake.

For Trump to uniquely rely on 1952, legislation in 1952 without going further in saying that

legislation of 1999 has got to be considered, he's going to fail.

You've got most of the people talking about this right now.

They don't even talk about legislation.

They just talk about these massive swaths of concept which is race and religion.

They don't understand there's a test.

There's a balancing test, and everything comes into effect in that balancing test.

Pirate Ships and Gunnery It should be no surprise that wreckage and

debris from pirate ships lays in the depths of the ocean.

That being said though, it does raise the thoughts of how damaged these relics are.

Well as it turns out that their weaponry was pretty durable a whole loot load of it was

found between 1966 and 2014.

How long have those been there?

In 1718, Infamous pirate by the name of Blackbeard was forced to sink his ship after it was stranded

in shallow water off the coast of Beaufort.

In 1966, the ruins of Queen Anne's Revenge were discovered in the water.

The wreckage of this ship contained thousands of artifacts and weaponry used by blackbeard's

crew.

In 2013, North Carolina's Department of Cultural Resources whipped out the big guns, literally,

pulling a set of cannons weighing more than 2000 pounds apiece from the depths.

All in all, twenty different cannons have been recovered thus far, with the recovery

set to conclude in 2014

Doomed Emeralds When you think of lost jewellry, you often

think of the ending to James Cameron's Titanic where Rose dropped that necklace in the ocean.

Well this is nothing like that.

In fact, This is probably the sequel in which someone discovered that piece of jewellry

and it turned out to be haunted!

In 2010, an Amateur diver and treasure seeker, Jay Miscovich finally found his treasure deep

in the Gulf off Florida.

What He discovered was an bracelet of emeralds worth millions.

This will go down as one of the strangest things uncovered in the sea because of the

controversy surrounding the findings.

You'd think Miscovich's emeralds would've made him wealthy man right?

Nope, Not at all.

Instead, Miscovich was slapped with a court order as soon as the news broke out about

his incredible discovery causing the feds to get involved.

A court order granted him only temporary custody of the emeralds, and because of that, Miscovich

couldn't sell even a single carat.

And then, there's the mystery surrounding the emeralds—no one's really sure where

they came from.

You'd think that'd be the end right?

Nope!

This story only gets creepier.

"How does a story like this get creepy?"

You might ask.

Well it turns out that Miscovich ended up killed himself, leaving many questions unanswered.

Some said he could no longer wait to gain back what he found because he was deep in

debt.

Others claim he found being mired in a federal investigation to be his tipping point.

Apollo 11 Remains So this is actually quite incredible when

you think about it.

In 2014, Amazon founder, Jeff Bezos uncovered components of two F-1 rocket engines from

Apollo 11.

Considering that these components have been submerged for around 50 years is pretty amazing

to think as they look to be in fairly decent condition.

They had been lying deep in the Atlantic Ocean, since 1969.

And they are part of the craft that allowed astronauts to be sent to the moon for the

very first time.

The engines are one of the strangest things ever recovered, not because it's such a

feat to have been found, but because Bezos' efforts seem to have no underlying reason,

as if one day he woke up and decided out of the blue, to recover the engines simply because

it 's something he could do.

Which is why Bezos funded the whole project and also why the press has called him "insane."

YONAGUNI MONUMENT On the southern coast of Yonaguni, Submerged

ruins were discovered and are estimated to be around 10,000 years old.

It's origins has been among debate as to this day, it is unknown what culture these

ruins originated from.

The rock formation known as the Yonaguni Monument is a bizarre series of rock structures that

look like ancient stone buildings designed by a lunatic.

There are all kinds of architectural oddities, including lots of 90-degree angles, straight

columns, a boulder sitting on a platform and a rock protrusion that looks like a face.

It almost looks like it was created using machinery just by how crisp the whole structure

looks.

Scientists are split over whether it's man-made or a natural consequence of earthquakes and

strong currents.

THE LOST CITY OF HERACLEION Lost underwater cities are no stranger to

media attention.

Some of the best folktales and even films have been created using this plot device.

That being said however, did you know that there's plenty of underwater cities that

have been discovered around the world?

Take this one for example as this city has been sighted as one of the greatest underwater

finds in history.

After four years of searching, a team of archaeologists led by head archeologist Dr. Goddio found

an entire city lying hidden 30 feet below the surface of Aboukir Bay.

The city was known as Thonis to the ancient Egyptians, and Heracleion to the Greeks, who

named it after the mythological hero Heracles (Or Hercules as we commonly know him).

Hundreds of artifacts, from ship anchors to sarcophagus jewels, have been recovered.

Michigan's Stonehenge We all know about the original Stonehenge

in Wiltshire, England but did you know that in 2007, another stonehenge type structure

was found submerged within Lake Michigan nearly 4000 miles away from the original.

While not an ocean find, this is weird enough to be included on the list.

Mark Holley, a professor of underwater archaeology, and his friend Brian Abbott, made a truly

weird discovery when they were out on Lake Michigan taking sonar readings.

They found an array of vertical pillars that is strongly reminiscent of Stonehenge.

Even weirder, they're next to a boulder that appears to carry an ancient engraving

of a mastodon, and a pile of car and boat skeletons.

Again this is crazy to think that two similar yet extremely rare sculptures exist 4000 miles

apart from each other.

That is crazy!

THE MARY ROSE So yeah it's not exactly a shocker really.

Ships sink quite often.

What makes this ship impressive though is the fact that this ship sank in the 1510 and

was discovered over 400 years later!

Why is this surprising?

How about the fact that most of the ship was recovered?

Most ships that sink are pretty much unsalvageable and don't get us wrong, this ship won't

ever set sail again, However most of this boat's frame and even some of the outer

workings of the boat were in fairly decent condition considering how old it is and how

long it's been submerged for.

The Mary Rose may have a perfectly benign name, but its purpose was deadly.

It was one of the most advanced warships of its time, first setting sail in 1511.

After 33 years of use, it was sunk in the ocean North of the Isle of Wight, to be salvaged

by the Mary Rose Trust in 1982.

It was an extremely complicated and expensive operation, but they recovered hundreds of

artifacts that have lent historians valuable insights into the history of naval warfare

and the Tudor era.

THE GHOST FLEET So on this list we've had wreckages from

some of the most famous boats in history, The Apollo 11 wreckage and even underwater

statues and structures.

How can we top this list off?

How about the remains of an entire military fleet?

On February 17th, 1944, the Allied powers bombed Chuuk Lagoon, a Japanese stronghold

in the Caroline Islands.

This surprise attack killed hundreds, and destroyed approximately 250 aircraft and 50

ships.

The wreckage was submerged to the bottom of the lagoon, where it went undiscovered until

the 1960's.

When divers started investigating the site, they found the debris and wreckage of all

the vehicles that still contained all of soldiers' bodies.
