I was going to do both,

I was going to be in the Army, I was going to be a cop.

That's what I wanted to do,

and so I succeeded in both of those.

He was military police and he was a police officer,

so both of those were a big deal to him.

Because that's what he always wanted to do,

was help people.

(engine roaring)

My driver actually for some reason saw it,

but they were pretty close to the vehicle.

And he said he saw two of them just come up and just.

RKG3 is a Russian anti-tank grenade,

it's got a copper core that penetrates armor.

It went through the door,

missed my leg, went underneath the seat,

then went through the forearm.

And the second one that hit the window

and it actually blew the 800 pound armor window

off of the Humvee.

(loud blast)

I remember waking up half way in his lap

and he thought I was died.

Three torn discs in his back.

When he walks he's just in excruciating pain.

He has partial feeling in his left leg from here down.

Short term memory sucks.

I get confused easy.

He has the concussion from the blast

and the migraines is a result of that.

[Nathan Voiceover] All the time just get sick.

Just to the point of vomiting sick.

He has depression, anxiety.

[Nathan Voiceover] I get so over stimulated.

If something comes up that I don't have planned,

I feel like I can blow a gasket sometimes.

I used to not be like that.

I guess it's from PTSD or the head injury.

A lot of the symptoms they've studied are for both.

(piano music)

I fell in love with him when I met him.

By the third date we were always together.

We never left each other.

Our fourth date he pretty much he started crying.

He told me he was crazy and he hoped I would still love him.

That he had severe depression and anxiety

and that he had a traumatic brain injury.

And I told him I still loved him anyways.

(piano music)

Emmy's my step-daughter.

Love her to death.

I never knew that a child could actually

care for a step-parent the way she does.

She really loves me.

We always hang out together and he's been really great.

(upbeat music)

They took us down to the Saints training facility

and they had been practicing.

Operation FINALLY HOME called us and said

they're doing interviews.

We thought they were just asking Nathan

about what happened overseas to him.

Then all of a sudden Jahri Evans comes in.

We're happy to announce that we're going to be

moving you home for Christmas.

We're going to build a home,

so you guys have been accepted.

And then they said, "Congratulations,

"you got a house in New Orleans."

I was just shocked and I was just so happy.

I don't even know what to say.

I almost went into shock.

I thought it was awesome, I was ecstatic.

I'm pretty much excited that there's good people out there

who are really nice to people like Nathan,

and what he's done for our country.

(acoustic guitar)

Dedication day is obviously the culmination

of everything that we've done for Nathan thus far.

It's in end to the project in some ways,

but it's really a start for he and his family.

(audience clapping)

I'm really blessed and I don't know what to say right now.

I'm just extremely blessed.

I don't know what else I could really say,

but thank you.

I felt for a long time, I haven't deserved it.

(audience clapping)

I love you.

So I'm going to make the best of it.

It was so exciting just to hear the oohs and aahs

and having them experience

what we've been working on for so long.

Just walking through in every room

was just something more exciting

so that was great.

I feel there's a new chapter in our lives.

A new start, maybe a new book.

My book has not been the best

until I met Tabitha actually.

It' been a pretty rough,

but she's been there for me.

Tabitha's been there and Emmy's been there.

I just don't know what to say.

Without these two right here

I wouldn't be here today probably.

I just want to say thank you

to Operation FINALLY HOME,

Tyson Construction,

all the volunteers that put everything into this.

All the builders, suppliers,

the construction workers,

I mean down to the guy slinging the paint in here.

Hey guys thanks for watching Beyond Science, it's Mikey Chen.

You know, when I first heard that vampire bats are a real thing.

I was kind of freaked out.

But then I did some research and was informed that

they usually only feed on the blood of creatures like birds and cattle.

And instead of feeling of being relieved,

I thought I bet these things are just [settling] for animals

and what a hundred percent suck a human dry, they have the chance.

I mean, come on, you can't trust anything that suck blood to stay alive.

That's why it didn't really surprise me when recent news reports are saying

that these vampire bats have been caught feeding on human beings.

And this is a huge problem in more ways than it watchs.

First of all, it's a bat sucking your blood, that terrifying enough.

But vampire bats are also known to transmit rabies.

So the disease could possibly spread everywhere

if these bat continue to feed on human.

Researchers believe that

the vampire bats are able to enter houses through holes in the roof or windows

as well as target people sleeping outside.

So time to install the extra door and grab some garlic.

And if you're wondering how the researchers found out that

the bats are feeding on human blood,

It was done through an experiment

at the Federal University of Pernambuco, Brazil,

where a test was made to see

what vampire bats will do if there was a scarcity of birds to feed on.

These particular breed of vampire bats also known as the hairy-legged vampire bats,

inhabit forest in northeastern Brazil

and are one of the three species of vampire bats

that feed only on blood.

Researchers analyzed 70 pieces sample from these bats

in a cave in Catimbau national parks Brazil

and found that three of the 70 samples have human blood in them.

This was surprising to them because in previous experiments

that bats actually starve themself to death

instead of drinking to the pig or goat blood that was available to them.

But this time, they actually drink human blood.

Apparently the reason why bats don't usually feed on mammal blood

is because mammal blood is thicker and harder for the bat system to process.

I guess humans don't really have that problem.

You know, in Chinese belief

if a wild animals suck a human's blood or eat human flesh

it becomes like an animal demon.

And when it has a taste of human blood or flesh

it's only gonna target human beings.

So, I don't know, maybe we're going to see

a bunch of bat demons flying out of Brazil one day.

Anyway, one of the explanation for this phenomenon is that

birds are getting harder and harder to find,

so the bats are resorting to such bloody measures.

An earlier study has shown that about half of the 510 species of birds in Brazil

are very sensitive to any disturbances by human.

So, if we continue to destroy their habitats and they disappears completely

then maybe the vampire bats in the region

which is really go on a rampage turning to vampire

and then there you go, vampire apocalypse.

I just want to say, if that happens

that would really suck.

Next up, apparently two teenage girls age 13 and 16

were hospitalized in Peru

after they were found possessed by strange chain messages sent to them through Whatsapp.

And if you don't know,

Whatsapp is a very popular messaging application.

These messages were supposedly satanic and somehow took over the girls

making them roll around the floor and babble incoherently in their home in southern Peru.

Their family called the paramedics immediately after they saw what's happening

but somehow found the time to actually film the girls.

The video shows the two teenagers wailing as help rush to the site.

They seem to be possessed

but was this really a supernormal demonic attack or

was it just somewhat sick idea of a joke?

We really don't know.

The footage shows the girls wearing PJs

and appearing to suffer from, what looks like convulsions.

Apparently the girls were also sedated

before being brought to the hospital as reported by a neighbor

who witnessed the whole thing.

The doctors at the hospital couldn't really shed more light on the situation

they only said that the girls were in a historical state when they arrived.

Ok, couple of things doesn't really add up for me here.

First of all, don't all teenage girls just babble incoherently anyway

and let's say this was real

and the girls were indeed possessed.

Explain something to me?

Is that is the double using whatsapp now?

and if that is the case, can you now exorcise demons to the use of instant messaging?

i guess that this could happen

because, I mean, that The Ring girl killing people through videotapes

By the way, just a random bit of information.

I know that The Second Ring, The Ring sequel is coming out

I just want to say that,

the last horror movie I've ever seen in its entirety was The Ring.

and after that I couldn't watch any horrible movie.

I was so freaked out after watching that movie.

and I was on a date actually watching the first Ring movie.

I just want to say, yep, scream like a little girl, not a good date.

And lastly guys, this week is really exciting

because the magazine, the Beyond Science magazine

will be coming out in just a few days.

Our research teams are already hard at work, putting the content together

and they found some really interesting fact on mermaid sightings.

And, even possible evidence for an ancient nuclear war

that predate the modern history of mankind.

So, I hope you guys will have that much fun learning about this stuff as we did finding it.

Anyway, the magazine will be launched on January 28.

I think that's a Saturday.

And like I said before,

and report on the crazy things that science can't explain.

10 English Weather Idioms and Expressions | Speak English Like A Native - Duration: 5:41.

to teach you ten idioms about weather

that we use in English. Are you ready?

We love the weather in England, we love

talking about the weather, which is crazy.

because, it's one of the most depressing

things about England.

The weather is not great, but it's so

unpredictable that we always talk about it.

And a lot of weather expressions have

become idioms that we use in general

English. Just to talk about general life.

Not specifically the weather, but general

life and that's what I'm going to talk

to you about today. So we have 10

expressions make sure you subscribe to

I want to teach you as much English as

me on YouTube. Let's go with the top 10

weather idioms in English.

Number 1: "as right as rain". How are you today?

Right as rain, okay? Just means you are

absolutely splendid,

healthy, happy, "right as rain".

To "be a breeze". If something is a breeze, a breeze

like a small wind, breeze. If something is

a breeze it's easy, don't worry about it,

don't worry about the exam it's gonna "be a breeze".

You'll pass, no problem, you'll see, it'll "be a breeze".

"Take a rain check".

If you "take a rain check" it means you're going

to have to cancel or reschedule plans

that you had with someone. So you can say

I'm sorry I think I'm going to have to

"take a rain check".

Can we meet next week instead?

If you are "under the weather", which surely we always

are, because the weather is in the sky.

But if you are "under the weather" it

means you're a little bit ill. Not

terribly ill, but not 100%. I think I'm

going to go home now, I'm feeling a

little bit "under the weather".

The next one is "break the ice". If you "break the ice"

with someone.

You start talking about a topic to make

socially a more relaxed situation. When

my friend meets someone new

he asks them what their favourite type

of triangle is, just to "break the ice".

An interesting way of "breaking the ice".

A very common proverb is that

"every cloud has a silver lining". So imagine a big black

cloud in the sky, but the lining, the

outside of the cloud is silver. So, you

know even though what you see it's a

very bad thing, just believe that right

behind it something good is going to happen.

Another idiom is that

"it never rains, but it pours". When it pours

it means that it rains very, very, very

heavily. So "it never rains, but it pours".

This means that things don't just go

wrong, things go very wrong. Like first

you lose your house keys, then your car

gets stolen and your passport disappears

and then.. hey "it never rains but it pours".

You can "steal someone's thunder", if you

"steal someone's thunder", it means you

take away all the attention away from

someone on their special day, okay, on

their special moment. So if your friend

is getting married and on the day of the

wedding you announce that you are

pregnant, you might "steal their thunder".

Yep, another way to "steal thunder" of your

friend on her wedding day could be to

wear a beautiful white dress at the

wedding. Not a great idea, because you

don't want to "steal the thunder" of the bride.

The next expression is about the

weather, all right. "it's raining cats and dogs".

"It's raining cats and dogs" means

it's raining very, very heavily, it's

pouring, it's "raining cats and dogs".

And finally another one about

clouds if you are "on cloud nine",

yes, cloud nine. I don't know why cloud

nine, but if you are "on cloud nine" it

means you are extremely, extremely happy.

So, on your honeymoon

you could be "on cloud nine", everything is

perfect. You have a new wife, you're on

holiday, that beautiful location, ah I'm "on cloud nine".

Draw Famous Characters In Other Time Periods | New Art Challenge - Duration: 12:21.

welcome to fun Friday hey everyone this

is Mei Yu how would some famous

characters look like if they were in

different time periods today I'm going

to turn someone own characters into

their medieval Renaissance and modern

version let me know what you think and

if you enjoyed this video give it a big

character is from a sci-fi series so I'm

going to go back in time and reimagine

him as a medieval character thank you to

all of you who liked subscribed and

commented on my last video I love

reading about how you felt about my

drawings I was actually emotional when I

drew them and when I read some of your

comments

I felt that us connected with you

through my art thank you

you

I love reimagining Darth Vader as a

medieval knight the helmet was a little

challenging and I decided to add a visor

piece with narrow eye slits

some electric some medieval helmet for

his suit I tried modified their shapes

to set a suit of armor design I had in

mind there were some things I needed to

add like the big armored shoulders

at first I didn't know how to make his

red lightsaber work in my design

and then I thought a big sword would be

a good fit

but what color would it be

you

I added some we're detailing in the arms

and legs and his armor I was thinking

about how most suits of armor are great

but I just couldn't imagine Darth Vader

in gray so I decided to layer the color

so that he'll still look metallic but

also more dark

I try different shapes to get a metallic

feel and also other colors like hints of

gold

to make my medieval Darth Vader closer

to this time I gave him a red plume in

the back

I think that's works really well with

this character and now he's got a red

weapon looks like he just made a point I

think my knight Vader looks pretty epic

I haven't watched this movie yet but I

think drawing Gamora from guardians of the

galaxy as a Renaissance woman in the

1600s better be pretty cool

I think Renaissance dresses are quite

elegant and looking forward to adding

some more intricate detailing and really

like her hair I think I can have some

fun with the colors for this one

the biggest challenge was designing her

outfit to make it work as a big dress

similar to what ladies wore back then

I gave her an extra and kept her open

front to make it connect with the

original coloring her with so fun I gave

her dress a shimmery effect

you

it took a long time to get this effect

with all the different color layers and

by the end my hand was getting sore if

you seen the new movie let me know what

you think in the comments you liked the

first one or the new one better

because I didn't want her whole dress to

be dark I decided to brighten it up with

red similar to her hair color I think it

really brings it out to connect with a

renaissance feel more I decided to give

the Morris dress some intricate Damus

patterns on the red fabric well I think

it looks really elegant

I think Renaissance Gamora looks

beautiful this is for all you

subscribers who've been asking me to do

a Zelda theme drawing although I haven't

played this game yet I love to draw a

link for you let's see how I'll turn him

into modern times

I think his little beanie it's really

cute I didn't want to make it too long

or pointy you have to look like what

people today would wear I give him a

hooded shirt with a long sleeve shirt

underneath I knew I needed to

incorporate his shield in there somehow

and after some brainstorming I came up

with a shoulder bag like he's taking a

casual walk in the city if you want to

see something similar check out this

video where I drew Disney Princesses as

modernly

what are what he's doing

link has various shades of greens and

different versions from my drawing I

went with something bright

I wanted to give him some kind of boot

so I went with these that kind of rugged

but shorter than what he usually wears

to set the time period better

I think modern league looks pretty cool

it looks like someone you can bump into

at a coffee shop or in the park

Almost two years.

Prepositions! Use "in" when it's in and use "at" when it' s at and don't even talk to me...

Amigo Gringo, how are you? I'm Mr. Teacher Paulo and I also have a YouTube channel. I teach English.

But today we're not going to do an English class.

You know why? I want a Portuguese class. I have questions that nobody can explain to me.

I want you to explain. You are Brazilian, right?

-Yes -You speak Portuguese.

I'm Brazilian, I speak Portuguese...oh my God.

How do you say...I was born in a small city outside of Boston.

To me, it's a suburb. But it's not a "subúrbio"!

Right? Because "subúrbio" implies it's a poor area outside the city.

So how do I call these places in Portuguese?

We don't really have many "suburbs" in Brazil.

Generally, in Brazil, if people have money they leave the "subúrbio" and move to the city center.

Like "downtown."

If you say "subúrbio," it's like the opposite. That's a good thing to know.

"Suburb" implies you have money.

-A lot of it. -And you have one of those TV houses.

I think maybe you could say "I live in a 'noble area.'"

Side note: don't use that in English. "Noble area."

It seems you're living with kings and princes. That's not the term.

It's an "upscale neighborhood." But that's inside the city. Outside of the city, it's a "suburb."

"Educated." If someone is "educated," does that mean they are well-behaved? Or that they studied?

Because "educado" in Portuguese is both "polite" and "educated."

So "education" can also be both.

I went to college, that's my education.

My mother raised me well, that's my "education."

Right. College is your "higher education."

In really formal Portuguese - you'll barely see

anyone use it, "conhecê-los" is correct.

"Lhes conhecer" is used by a lot of people, but older people.

In general, in colloquial Portuguese, informally,

Romantic question...ok, the question isn't romantic, but the subject is romance.

"Te amo" versus "Te quero". To me that's "I want you", which is sexual.

Exactly right. Maybe - you speak Spanish, right?

Ah, it's Spanish that's different.

In Spanish, it's different, because "Te quiero" in Spanish is "I like you."

But it can also sort of mean "I love you."

-"Te quiero mucho."

But "te quero" in Portuguese will generally be sexual.

"I want you just for me."

So I'll stop using it with my cousins.

What should I say? "It is heat," "It is hot," "It's doing hot"???

You can use any of them.

But I have a problem with that. "Heat" is a noun. You can't "be heat."

That's like saying, "It is door."

No, it's the same as "It is hot."

"Hot" is "quente."

It's an adjective. But "heat" is also an adjective.

-Heat for me is "heat." -"This heat."

It's a noun.

But in Portuguese you can say it!

"Tu" and "você". [You and you.] I know that in southern Brazil they use "tu."

But what I don't get is why others use "tu" but don't conjugate the verb in the "tu" form.

That's everyone. Almost everyone in Brazil uses "tu" but doesn't bother to conjugate it.

OK, so when do I use "tu" and when do I use "você?"

How do you say "farmer" in Portuguese?

"Rancher."

But do me, a "fazenda" is a ranch.

A rancher would seem to have a whole lot of land.

So if you make a living in agriculture, you're a rancher?

If you make money in agriculture, you're a "agricultor".

A rancher generally makes money raising animals.

With "cattle."

He'll have "cattle", he'll have "milk"...

It's a ranch. He's a rancher.

The problem is that a farmer also makes money that way.

That's the question, because if you raise crops you might also make money from animals.

For us a "farmer" is that guy who has a farm,

-An enormous farm. -He works with...no, it doesn't have to be enormous.

We talk a lot about family farms.

-Those would be small. -Like a "farmers market."

-Exactly. -Those are small places.

Those are places that have, like, special onions and come sell them in the city at a farmers market.

But there's another big problem.

In English, there are farmers and ranchers and that's it, right?

Farmer, rancher, I think that's it.

In Portuguese there's the "fazendeiro," who generally takes care of cattle.

There's also the "agricultor" who might not have cattle but will have a piece of land.

That's certainly a farmer.

You also have the guy who owns a "rancho."

"Rancho" owner? A "rancho" and a "fazenda" (=ranch) are different?

But what is a "rancho" if not a ranch?

It's a small ranch.

It's the size. You can have a fazenda, a rancho, there are a lot of other names, too.

"Rancheiro," is there such a thing?

I don't think so.

-So what do you call the owner of a "rancho?"

There's also a "granja."

That's a place that mostly works with poultry.

I know how I'm going to solve this problem.

I'll never leave the city again.

If a city is in the "interior" of a state, can it be on the coast as well?

Can what you call an "interior city" be on the coast?

That's what I've been told, but I never understood that either.

That's the "exterior", on the edge of the sea.

"Interior" should, in theory, be far from the sea.

You could be in the interior of Pernambuco but also be on the coast.

Progress for Veterans Disability Claims - Duration: 15:32.

Good afternoon, and welcome to this issue -- this segment of Facebook Live.

My name is Cindy Speaker.

I have with me today, attorney Nathan Guin.

He's going to talk with us about a very interesting issue in a court case that just happened,

last week.

Nathan, thanks for being here today.

Thank you for having me.

I appreciate the opportunity to talk about such a timely and relevant topic for our veterans.

Yeah, well I enjoyed you last time, and you -- This whole issue about veteran's law is

very interesting, even to someone that does not specifically have a veteran in mind that

this is relevant to.

It's relevant to all of us, because we care so deeply about our veterans.

Yeah, absolutely.

It's a subject that's close to everybody's heart, and something that we're happy to help

people with, and shed some light and information regarding VA benefits, people who may know

veterans, or even if they don't, just to give a little bit of insight as to what they're

going through on a daily basis.

Right.

Well, we're going to talk about a specific case.

I have some notes, here.

This is a recent court decision that was decided by the United States Courts of Appeal for

the Federal Circuit, just last week.

How did this new decision come about?

Tell us a little bit about it, so we can kind of wrap our heads around what's at stake,

here.

Okay.

Basically this case, and I'll try to be as brief...

Okay, so we got interrupted there.

This is Cindy Speaker, I have Nathan Guin with me, an attorney with Gardberg & Kemmerly.

We got cut off on Facebook, technology is sensitive, but you can pick up the first minute

in the last segment on this page, on Facebook Live, and now Nathan's going to continue in

talking about this case and what it means.

So go ahead and pick up there, Nathan.

Yeah, I think we were talking about basically the veteran had appealed, Mr. Monk had appealed

and that they are holding his new decision for his claim for disability benefits to wait

for the personnel board to make a decision regarding his discharge upgrade.

And so, the VA and that particular board work hand in hand, and so there's really no need

for the delay in Mr. Monk's mind, and that's his contention.

So basically, what he did was filed what's called a Writ of Mandamus to the Court of

Appeals for Veteran's Claims.

Now, that's something that individuals can do to try to basically force action on the

part of the VA, they can talk to or send a motion or writ to the Court of Appeals for

Veteran's Claims stating their case that they have exhausted all of their remedies.

Basically, they've done everything they can and there's undue delay and it's an unreasonable

withholding of the new decision, and that the VA should be compelled or at least give

an argument as to why they haven't issued that decision yet.

So, he filed that with the Court of Appeals for Veteran's Claims.

And, in addition to that, he also requested, and this is really where the case gets interesting.

He requested that the Veteran's Court certify a class, for a class action, or a similar

aggregate resolution procedure.

Basically, they can talk about similar cases all in one for veterans who had applied for

VA benefits, had timely filed a Notice of Disagreement for an appeal, had not received

a decision within 12 months, and had demonstrated medical or financial hardship as is defined

by VA regulations.

So, that's kind of a different segment but there are ways to expedite your claims based

on medical, severe illness, and also severe financial hardship.

So that was the basis of his writ.

And so basically, the Court of Appeals for Veteran's Claims, to get us to the federal

circuit, Court of Appeals for Veteran's Claims denied his writ and basically said they didn't

have the authority, they lacked the authority to hear such cases, they can't hear class-action

cases or aggregate resolution cases, which Mr. Monk then appealed to the Federal Circuit,

which brings us to the now, which is the most recent decision from the Federal Circuit.

Basically, to put as short and simple as possible, the Court of Appeals for Veteran's Claims

has all of the authority to hear class-action claims, to certify classes, to have a similar

aggregate resolution proceeding, and essentially had just refused to do so because it seemed

as if they just didn't really want to.

In fact, the Federal Circuit went as far as to say that the refusal to hear class-actions

or aggregate proceedings was an abuse of discretion in their decision.

So, it was a pretty powerful decision from the Federal Circuit and certainly something

that I think will be helpful for our veterans going forward.

But that's kind of the case that brought it about, our way of background.

Right.

And talk a little bit about the implications for veterans going forward, and also when

you talk about a class-action, will this simply be limited to situations where the veterans

are looking to upgrade and go through the process that I believe Mr. Monk did, or is

this relative to any type of veteran's claim where they could potentially be handled as

class-actions?

Okay, so for the first part of that question, really what it means is, that a lot of times

everyone knows, I don't think that it's any secret that the VA suffers from an incredible

backlog of cases.

They take an enormous amount of time to get any decision back to veterans, no matter what

stage of the process they're in.

How long do they typically take?

Well, depending on where you're at.

So, if you put in a notice of disagreement, we've seen anywhere between a year and a half

to two and a half years to get a statement of the case.

And if you appeal a statement of the case to the Board of Veteran's Appeals, you can

either request a hearing or not.

Even still, at that point, to get to the Board of Veteran's Appeals decision or your hearing

can take anywhere between two and a half to three years.

And that fluctuates but the light fluctuation we've seen recently has been for longer time

periods, longer wait periods.

So, what this stands to do is, hopefully shorten those wait times.

Right now, the only kind of recourse you have for such a delay is what Mr. Monk did, which

is file a Writ of Mandamus, which a lot of people, veterans representing themselves,

they're not going to know how to do that or maybe not even think that that's an option.

So, there's just a lot of issues with that and it's all individual, so it's a case-by-case

basis and the courts contention has been, for the longest time, that even if they're

similarly situated, all of the facts are different, therefore it's not a common question.

But that's not what the Federal Circuit said so this should give the Court of Appeals for

Veteran's Claims the ability to handle larger amounts of cases in one fell swoop that are

similar and get these people, the veterans, their resolution whether it's positive or

negative.

And it's not to guarantee that there's going to be a grain of benefits, but they need to

know if they need to appeal, they need to have some kind of resolution even if it's

negative.

The waiting is really, from what I've seen with our veterans too, is the hardest part

and by far and away the most frustrating.

Oh, I bet, I bet.

So, tell us some of the specific types of cases that could be positively impacted here.

I don't know what types of claims are put forth.

Right, so what we see the most, and really to give you a lawyer's answer, it depends.

So, this case basically just tells us that the court has that authority.

The procedures and processes are not in place yet, that's something that will be developing,

that's something we're keeping a very close eye on to see, and try to get in to that ourselves

you know.

Once the processes are established, how can we help out our veterans by taking advantage

of this?

Generally speaking, the ones that we see the most, and I've got a couple of notes here,

when we see the most delays is with concurrent retirement disability pay.

So those are people who are getting retirement pay from the military and disability and there's

coordination between different departments, which usually is lengthy and takes a really

long time because there's different requirements for how you get that concurrent pay.

Additionally, adding dependent spouses and children to a veteran's 30% service connected

or above, they can add a spouse or a dependent who is under the age of 18 or basically under

their care, and get additional money for those dependents.

Those are things that, if you have 30% and you can prove that you're related should be

granted, but you still have to wait sometimes.

And those are a little bit quicker depending on what regional office you're working with,

but that still takes half a year to a year at the least a lot of the times.

We also see it with veterans of advanced age, so you can request expedited consideration

for those, but the rules for that are very strict and the ages are kind of extreme, so

we see a lot of delays there.

And then also claims that have been remanded by the Board of Veteran's Appeals.

So if there needs to be more evidence, hearing development, or more examinations, medical

examinations.

Those are supposed to be done, the examinations are supposed to be done within 90 days of

the remand order and we see people go in, you know, veterans go in six months to a year,

and we're doing everything we can to get these things scheduled, and you know they just take

them forever to do it.

So that's where we see the most delay but the delay is pretty much across the board.

So what will the process be?

Will they take existing cases and potentially put them in to similar classes?

Or is this only for veterans that have yet to actually file for disability?

That's a really good question.

Whether or not it's going to be, I imagine it could be retroactive and that means that

the claims have been dealt with and there's been some resolution.

I would imagine, and like I said the processes have not been set up yet, I'd imagine that

these kind of processes will be open to any and all veterans who have already filed claims.

You know, Mr. Monk's case, he had filed an appeal and the whole basis of his class was

veterans who had already filed appeals.

So, and in that context is where the Federal Circuit decided that the Court of Appeals

for Veteran's Claims has the authority to heat class-action suits so I think that existing

claims would fall under that.

How they will certify those classes and how they'll be kind of classified and arranged

is yet to be seen, but like I said something we're keeping a close eye on, but it's going

to be very interesting because they're basically making this all from scratch.

Yeah, yeah.

Well, for those that are watching or those that watch this on demand later, I'm sure

the Gardberg & Kemmerly will be on the forefront of this, as you said they'll be watching it

and my guess is that you will handle, if the classes develop and that becomes a potentiality,

I assume you will probably handle some of those class-actions yourselves.

Absolutely.

That is something that we are currently looking in to and making sure that we're keeping up

with all of the developments so that we are prepared to take on any new responsibilities

and any new challenges that come with class-action cases and aggregate claims.

We certainly have a number of veterans that seem to meet the requirements and Mr. Monk,

you know the class that he's, you know, suggested being certified so I think that we certainly

have got a lot of people who could take advantage of that process to begin with, so definitely

something we're looking to take advantage of to help our veterans out.

Yeah, yeah.

Yeah, when you talk about the time that it takes to get through the system, it's really

almost unforgivable on the part of the VA that it takes that long.

Are there any other potential solutions other than the class-action that you see?

Yeah, and this is something that Mr. Kemmerly have talked about and our whole office really,

about different solutions.

Because while this is a big step in the right direction, there does seem to be kind of a

common sense, easier to way to deal with things and whether that could be implemented, you

know the pitfalls of that may be I'm not really sure.

But on it's face it would seem that, you know the veterans bear all the burden when it comes

to these kinds of claims, when they appeal and they get a decision back, they're under

a time limit whether it's one year, 60 days, 120 days, depending on what stage of the process

they're at.

And if they don't get the appeal in by that time, well they're claim is just dismissed

and they're forced to refile and to re-open a claim is just a difficulty in and of itself,

and something that I would not want anyone to have to do unnecessarily.

And so really, it would seem that the easiest way, in terms of equity and just getting resolution

more quickly would be for the VA to have timelines implemented on themselves.

And I understand they have a lot of claims, you could even make it flexible for different,

you know, whatever process you're up for a Notice of Disagreement.

You know, give the VA x amount of time to get a decision out.

I guess, I think would be, or an issue would be that, what would the penalty be if they

didn't?

But at the same time, there would still be a penalty, there'd be some kind of procedure

to it.

And it just seems like if you're going to hold the veterans accountable with these time

limits and give them these short periods of time to produce all of this evidence and produce

their arguments, it seems like it should work both ways.

Maybe that's a little bit too easy to be true but that's certainly something that we wish

they would do around here because that would make everyone, it would make the veterans

lives a lot easier and you know, a lot of times, they're not upset necessarily.

Obviously they're disappointed when a claim gets denied, but it's the waiting and the

not knowing that if they're going to get denied and if they do happen to wait two or three

years to get that denial, it's really the most frustrating part is just the not knowing.

And really the feeling as if they just don't care about getting it back to them, these

people have lives to lead too and the veterans, you know, they don't want to be waiting around

for two or three years to get a decision.

Like all of us, they want some kind of resolution so that they can move forward with it, whether

that be with an appeal or say, "Okay, I gave it my go", and even if they don't want to

pursue it, it's one less thing that they have to worry about.

Yeah, yeah.
