Youtube daily Jul 11 2017

hey everyone this is Sarah from Sarahtypes.com today I'm going to show you

how to build your own automation so you can have an email list and have people

subscribe to it and once they subscribe to it an email they will get a message with

a link for download it's really great if you're doing some email marketing on

your YouTube channel and you have a free download, they can just click on the

link go sign up to your newsletter and then get the free download and then

you have a new subscriber so I'm going to show you how to do this with

MailChimp first thing you want to do is go to MailChimp.com and if you don't

have an account with MailChimp you'll want to sign up for a free account you

just need to enter your email address and your username and password and you

should be good to go. I already have a MailChimp account so I'm just going to

go back and login to mine once you're logged in you should get to

this dashboard I already have an account so I have a bunch of things going on but

you'll want to pay attention to the menu at the top where you have your lists

first things first you want to create a list so if

you click on list you can see I have a few here you probably have none if

you've never been into Mailchimp before so you just want to click on the create

list button and you'll see if you want a new list or a group, I'm not going to get

into groups at this point so we're just going to create a list, you're going

to name your list - subscribers do see this so make it something appropriate to

the list. I'm just going to call it YouTube for the sake of this tutorial

and then for your from email address you'll want to make sure that it's an

email that you check often because if people reply to the the mail that they

get from this subscriber list it will go to this address and you'll also need to

put in some text of why they are getting this email so I'm

just going to type ' you're receiving this email because you

subscribed' and at the bottom if you've already set up your

MailChimp it's going to have your mailing address and this is

something that is required unfortunately so if you have a PO box that's

probably a better thing to use okay so if you scroll down the page you'll

see a section called notifications and this allows you to get email

notifications when somebody subscribes to the email or if they unsubscribe or

you can just click on a daily summary so that you just get a summary of how many

people have subscribed or unsubscribed that way you don't get a million emails

now that you're done you have the list here so you'll need to create a sign-up

form so I'm going to go and click on signup form so I can create a signup

form for people to subscribe to but you'll notice I have an error message at the

top that my email address needs to be verified so if you go into settings you

can see your default from email address and if you're new then you wouldn't have

verified your email yet so just click on the verified domain link at the bottom

of the input where it says you must verify you have permission to send from

Sarahtypes.com so just click on verified domain and then type in the

email address and click on send verification email so now you should

have an email from your email provider that has a verification code that you

need to enter in that input so I'm just going to my email here and load the

MailChimp email and bring up that verification code, then copying and pasting it

into the spot in MailChimp so now that it's verified we can create our first

signup form there are a few options you have the embedded form a pop-up or

integrated so I'll click on

the first option which is general forms and there's a bunch of different options

from the first drop-down menu like a sign-up Thank You page opt-in

confirmation email so you can actually go in and change those as well but I'm

just going to do the signup form for now and you'll notice that link I highlighted

we'll be using that later. To edit I just clicked on

the first box that said edit your content and I'm just putting in some

copy that the reader can see when they first get to the page to subscribe

so now I'm just going to go in and edit. I want the fields to be a

default view with email address, first name and last name but you'll see on the

right-hand side there's a column with a whole bunch of different fields you can

add just by clicking on them and if you want to add in your own you just click

on the text one and then you can type in the title for it you can also put in

website or image the list is pretty large

you can also choose which fields you want to be required so that the user has

to put these in otherwise they can't sign up and you do that by clicking on one

and then selecting required field and make sure you hit save field as well to

save that change just for fun I'm going to throw in some radio buttons asking

the reader what their favorite fruit is

you also have the ability to brand your form if you click on design it you can

change a lot of the colors, font styles and button colors as well as a few other

things like the spacing and also the font sizing so now that we branded our

signup form we're going to automate it you want to click on automation at the

top and then add automation on the right you can see they have quite a few

default automated emails and actions a lot of them are ecommerce based but we

don't really need to use these, maybe once you get comfortable with automation

and MailChimp you can try out one of their default automations but for our

purposes I'm just going to create a really simple custom one so click on

custom and then click on add automation you just type in the name for the

automation it can be whatever you want nobody sees it and then you select the

list you want to have that automated action with so it's going to bring you

to this automation screen and it has here you see the workflow recipe is the custom

and then schedule is every day all day by default so click on edit schedule and

if you want it to be immediately leave it at every day but then change the

timing to as soon as possible I believe this was the default but just double

check and then you'll also want to go in and click on edit trigger this is the

action it's going to take once they've subscribed so just click Edit trigger

and then in this window you're going to change the trigger so by default it's

when a subscriber is manually added which means you've added that subscriber

so I'm going to change it and click on list management and then you'll see on

the right-hand side there's an option for when a subscriber joins your list

'YouTube' so we're going to choose that one so that

this email sends once someone actually subscribes to that list and then I'm going to

change the delay from one day to immediately and then I'm going to click

on update trigger on the top right so now we have the automation part setup

there's also two other options in segments but you can just leave that as

default it's not necessary at this point and same with action you don't need to

change that so now we're ready to design our email you can either click the

question mark or hit design email on the right in this screen you'll just want to

enter your name, subject all that stuff and then click Next and from here

we're going to choose how we want the email to look you can either choose a

blank layout or you can go into themes and see what themes they have already

and then there's also saved templates in case you have done an email template

before so we're just going to click on the blank layout just pick whichever one

looks good to you it's going to open this page with the designer and then you

can edit all of the different chunks. First, I'm going edit the logo but clicking

logo and then replace and then put in my own logo and just hit insert when

you're ready and you'll see the logo appear in the box you can adjust some of

the settings if you go over to the right side and click on the Settings tab

beside content so I'm just going to click back to bring up that again and

you can choose the alignment and how big you want your margin so I'm going to

edge to edge I'm also going to click on constrain image dimensions for high-res

monitors so this just puts it in half of the width and height so it looks better

on high-resolution computers like MacBook Pro Retina and then you can move

along to the other blocks, I updated the text block and now I'm going to just put

in a feature image for this block

so you'll see once I've added this that there is a warning where it says this

image is so big it's going to crash people's mailboxes so they allow you to

change the dimensions if you just click let's let's fix it you can change the

dimensions I changed it to 400 width which should be good enough and I also

did the constraint image dimensions by 50% again so that's up to you but just

looks better on high-res computers and then I'm going to adjust the last block

of the email and that should be it

so for this example I'm creating an email so that when someone subscribes

they get an email sent them immediately and then in that email as instructions

on how they can download the freebie that I used to get them to want to

subscribe so what I'm going to do is use the read more button that is below the

text and they're going to be able to click that button to get to the free

download so you have to put in a link for this button in order for it to click

somewhere so you need to upload whatever your download is somewhere they someone

can grab it from so how I do this is I upload it to my Google Drive and then I

use bit.ly to compress the link so I'll show you how I do that now I'm going to

select the file that I want to give out as a free download and then I'm going to

click on the link icon on the top to share and I go to bit.ly next.

If you don't have an account you can create a free account easily and this

allows you to track the link so you could just put in the Google Drive link

but I put it in here so that I can get a smaller link and then also track how

many people have clicked it so you just click on create link and then you copy

the link from Google Drive and then paste it into the bit link and then you

just click on copy to grab the smaller link that bitly gives you so now I'm

back in MailChimp and I'm just going to choose web address which is the default

and you can also choose file as I show you here and in which case you would

just upload a file to MailChimp so it's up to you so I'm going to choose web

address and then I'm just going to paste the bitly link in the input below and

then I'm going to click Save and close so now my email is pretty much done you

can update the footer stuff below with your Facebook and Instagram and whatever

so I just clicked on next and now I'm back in the automation

you can see here

it tells you if there's anything wrong that you need to fix or if you're

ready to send so I just start workflow and then I clicked on

start workflow again so this means if someone subscribes to that email then

they should get an email back with that download link in the campaign that

you just designed so I'm going to show you how to do that so you need to have

some sort of form for them to fill out

so now I'm out of automation and back in the main MailChimp area and I click on

lists and chose the list for this signup form and then I just click on signup

forms so I'm going to select the general forms by hitting the select button on

the right and I'm going to grab the URL in the input under signup form URL I'm

going to copy it and I'm going to paste it into my address bar to show you what

happens when you visit this address so this is the form that comes up and you

can change the designs as I showed you so I'm just going to test it out and

enter my information and see if I get this email

so I'm going to hop back into the automation screen and just click on the

automation I just created and this will show me any of the stats so you can see

it has blue writing and it says number one in queue this means I have one email

subscriber in the queue which means that it's waiting to send out an email to

them with that download link so it's a good thing that means it worked so now

you can see on the top right I actually got a notification but I got that email

on my inbox so I'm going to click on that see the email this is the one we

just designed and then I'm going to click on the download practice sheet

button and it's going to take me to the google drive and this is where I can

download whatever it is that we chose as the freebie or whatever so if you go

back into MailChimp click on lists and click on the list we just created you

now can see you have one subscriber and it has their information and whatever

they filled the form out with so once you've got that link tested and ready

you can do something like put it in the description box of your YouTube video if

you want someone to download something that relates to it

you can see my example here it says download the strokes and drills

if I click on that link that's the MailChimp signup form and

this is what mine looks like so I would just put in my email and my first name

and I would get an email back once I click Subscribe or you can embed it you

can see my blog I have it on the right-hand side and you would do that by

grabbing the embed code on MailChimp so I hope that was useful to you it took me

6 Subtle Ways To Get Your Ex To Notice You - Duration: 5:44.

Hi, Brad here… and here are some subtle ways to get your ex to notice you.

If you're coming off no contact and are looking for ways to get in touch with your

ex, then using the subtle approach is best.

Remember, you don't want to give off the impression that you miss your ex or that you

need to talk to him or her for no good reason – instead, you want to reach out with clear

and obvious intentions… or, instead, you could try seduce your ex into contacting YOU!

Here are six tips that will help you accomplish this:

Tip number one – Like one of their photos.

Yes, one of the best ways to remind your ex of you is to simply like one of their photos

on Facebook or Instagram.

Trust me, your ex will notice.

This is a great tactic to have your ex reach out to you because it doesn't show any neediness

or desperation… and plus, who doesn't like a 'like' on Facebook or Instagram?

If you really want to make your presence known, you can easily just comment on that photo

too with something short and sweet like…

"Great photo!

Where was this taken?"

And since you're publicly commenting on Facebook or Instagram, it comes across as

non-threatening and friendly… and this is the best vibe to give off if you want to subtly

send a message to your ex that you're still around!

Tip number two – Post a picture or status that reminds your ex of a good memory.

Did you and your ex have a favourite camping spot?

Hiking spot?

A favourite café maybe?

Posting a picture on Facebook with some good friends is a great way to remind your ex of

some of the good memories you two shared when you were together.

But here's a bit of warning: if you're posting a picture with a date or someone of

the opposite sex, you'll come across as someone who's trying to make your ex jealous.

Right now, you DON'T want to piss off your ex – you just want to send friendly and

subtle reminders.

After awhile, your ex will reaching out to you in no time.

Tip number three – Reach out to a mutual friend

If you had a friend that you and your ex shared, grab a cup of coffee with him or her just

to catch up!

You don't have to mention your ex to this mutual friend while you're together… and

you don't have to try anything sneaky.

Just have a good time!

The hope here is that your mutual friend let your ex know that you two hung out -- so bonus

points if you think this friend is a loudmouth.

This is a super subtle way of letting your ex know that you're still part of his or

her life…but in a totally non-invasive way.

If this mutual friend begins asking you about your ex, then don't say anything negative

or noteworthy…just say something like, "I haven't talked tor my ex in awhile…but

I really he/she is doing well!"

Tip number four – Send a group message.

If your breakup was on good terms and you vowed to each other to be friends in the future,

sending a group message can be a great way to remind your ex of you.

The group message to set up a big group hangout is great because it shows that you don't

want to spend one on one time with your ex.

This way, your ex will be reminded of you and he or she won't feel obligated to message

you back.

You could try and arrange a party or a group hike through this message… or plan a small

day trip with a bunch of your mutual friends.

And this is also a great way to rebuild the attraction that you lost with your ex in a

group setting.

Just don't be discouraged if your ex doesn't reply or show up -- remember, it's probably

still a little strange for your ex to be seeing you in a normal environment right now, so

don't sweat it if nothing comes of this.

Tip number five – Host a party and send an invite to your ex on Facebook.

Again, just like the group message, by sending an invite to a party, you're implying that

you wouldn't mind seeing your ex but you don't necessarily want to spend one on one

time with him or her.

This also gives your ex an option to easily opt out if he or she isn't feeling comfortable

with that sort of thing yet.

Even if they say no to your invite, don't feel discouraged!

By sending an invite, you subtly remind your ex that you're thinking about them in a

positive way without coming across as aggressive or desperate.

Tip number six – "Tag" your ex on Facebook

If you find something funny on Facebook (or something that you know your ex really likes),

just tag him or her in the comments section.

But here's the trick: don't just tag your ex, tag several other people!

So if you see a really funny video of a cat chasing a ball of yarn, tag your ex and any

of your close friends that would enjoy a video like this.

This is one of the best ways to let your ex know you're still alive and well, and it

may encourage him or her to reach out and contact you!

Easy 2 Cup Dirty Poured Acrylic Landscape using House Paint Recipe in the Description below - Duration: 8:54.

hello and welcome to deliberately creative I'm Stephanie and I'd like to

welcome you to a quick painting experiment so I'm using Behr premium

plus ultra house paints that you can get these really great little 8 ounce

samples for 3 or 4 dollars each color at the hardware store I happen to get this

at Home Depot it's just as the hardware store closest to me

I am also mixing it with Liquitex pouring medium I am mixing in a 1 to 1

ratio so in my little cups I put 20 grams of pouring medium and 20 grams of

paint and then stir stir stir together to make a very nice even paint. This is

banana leaf green and I have yellow groove. There is majestic blue

and I am using the Nano white. I have other colors also but that's what I'm

using. I'm doing a landscape so I need a sky and I need ground. My sky I took some

of the white and the blue and stirred those together in this little cup first

then I poured some of the straight blue and straight white into it, and it

sort of got swirled around just a little look at that is that not pretty?

That's going to be the sky. I don't care if my canvas has a little bit of paint

on it I had paint on my gloves when I was

picking it up and moving it around. For my green flowing landscape I have mixed

some of the groove yellow with the majestic blue to get this darker color

of green in here. Then I poured that alternating with the banana leaf and

drizzled some of the sky onto it and some of the straight yellow onto it.

That's it nice and easy. So now what I want to do is move all of

these cups of paint out of the way. I'm pouring on top of a piece of freezer

paper it's a plastic coated paper that they would use for wrapping things

before they go into the freezer and being plastic coated the acrylic paints

peel right off of it after they're dry really cool so now I am going to pour

along this top edge and over the edge and across what I want to end up with is

some really cool shapes to the sky

and doing it this way it almost gives me some mountain type range too

Pull it out like this, I say pull, but really I'm pouring I'm not I'm not

pulling on anything I'm going to just run my finger through the edge and down

just like that.

now that edge is covered and that's pretty much all I'm doing for the sky.

now I've grabbed the ground now I have the ground and I'm going to pour it kind

of swooping down like this and swooping across I don't know if that's going to

make hills be different or not but I think it might give me some hills I

don't know might be totally backwards to what I was thinking sorry about that oh

it's kind of like desert like a desert landscape almost

I want that hill to sort of grow look at that oh that's cool I hope you like this

I hope you're enjoying going off on my little painting excursions sometimes I

take you out to outer space and sometimes I keep you planted firmly on

the earth sometimes we go under the sea and that's a lot of fun too the top is

nice and clear alright so now we have this lovely lovely landscape with this

green and yellow gold it's almost like it's a shadow side on this side and the

Sun is aiming down into here I'm thinking that putting a little hazy Sun

up in here would be kind of fun and I have that yellow so I think just just

for fun and I could be totally ruining it at this point but I think it's going

to have not a bubble there we go just just a son

and then it will have a tiny bit of

white that I'm going to slide through here even though this sinking don't

worry that white is going to be slid I'm just

going to use the back end of one of mine and even though it's sliding the Sun

also I'll be able to get it recovered back

mostly II but that's giving me that glow in the sky and by doing it like this we

have motion I like having motion in my sky this is

almost like swiping your finger through

and it's just giving me different different texture actually that heat

haze oh yeah okay there we go so now I'll let this dry and we will have a son

kind of getting that little haze around the Sun there there that's better

alright so now we have a Sun we have sky with clouds that are sort of drifting

through we have light on this side and shadow down this side that's a lot of

Passenger Accidents and Insurance Questions - Duration: 6:16.

So, if you're a passenger in the car, the driver has an accident, was distracted, who

pays for your injuries?

Is it that driver's insurance, your own insurance, health insurance?

How does that all work?

Sure.

In Pennsylvania, let's presume it's a Pennsylvania automobile accident, okay?

The Pennsylvania law that applies there.

Pennsylvania's a no-fault state, so you have essentially three potential levels of coverage,

automobile insurance coverage come into play.

The first is where we get the no-fault language in the act, and that first level of coverage

is called first party benefits.

It defines a minimum of $5,000 of medical benefits, really just $5,000 of health insurance,

to pay for your accident related injuries.

It comes from your own insurance coverage.

If you're in a friend's car, but you own your own car and you insured it with an insurance

company, the insurance on your vehicle, despite the fact you're in your friend's car, provides

this first level of coverage.

If for some reason you don't have your own car, or you don't live with a family that

owns vehicles, you will get that coverage from the vehicle you're occupying.

The second level of coverage that comes into play is that liability.

If your friend was distracted, and you let them get away with it, their liability coverage

is going to apply.

It's going to pay for your injuries and damages, depending first upon what kind of policy you

bought.

Let me address something that's very important here.

When you buy an automobile policy in Pennsylvania, you can select the full tort or limited tort

options.

If you select limited tort, you get a 20% reduction in your premium.

That's very appealing to people.

In exchange for that 20% reduction in your premium, you give up your right to collect

or claim an entire category of damages in any claim you make.

Under Pennsylvania law, when you're injured, you have two basic categories of damages.

You have economic loss, and you have noneconomic loss.

Economic loss is pretty easy to understand, it includes lost wages, unpaid medical bills,

medical liens.

Things that are economic in nature, we can calculate down to the penny.

Those noneconomic damages that you would be prohibited from collecting if you wear a limited

tort claim and include everything like pain and suffering, and scarring and disfigurement,

and loss of the enjoyment of life.

Let's assume in the example we're discussing that the person is a full tort claimant.

They are not prohibited from making a full claim for their damages.

You would make that full claim against a distracted driver if they were at fault for the accident.

That's interesting.

If their distraction caused the accident.

I can be a distracted driver, I can be sitting at a red light, waiting for the red light

to change, looking at my phone and get rear-ended.

I was distracted, but that distraction didn't cause the accident.

That's very different than if I'm driving down the highway, I get a text, I go to respond

to it.

I look back up, the traffic has stopped and I'm plowing into a line of traffic.

If the person is at fault, you collect against their liability coverage.

Under Pennsylvania law, unfortunately, and this has been true since the 1990s, there's

a state minimum policy of what's called a 15/30 policy.

That is, there's no more than $15,000 per person in the accident, and no more than $30,000

in the aggregate.

If there were five people in the car, all injured by this distracted driver, all five

of them would be entitled to recover no more than $30,000, and not one of them could recover

more than $15,000 individually.

It's a woefully inadequate coverage.

Wow.

The Plaintiff's BAR is working hard in the state legislature to try to increase that,

to get with the times.

I mean, when the auto law was passed, this was the state minimum, and that's over 30,

almost 40 years ago now.

Then we get to the third level of coverage, which is essentially uninsured, underinsured.

This coverage, again, comes from your own policy.

Coverage you buy to protect you in the event that the person who is at fault has one of

these state minimum policies, or has a policy that is inadequate to cover your damages.

It's called underinsured coverage.

It's also uninsured coverage, in the event, God forbid, that the person who is at fault

doesn't have any insurance at all.

That level of coverage is elective, and it's important to note that it's very inexpensive.

You should have it, because it guards you against these people driving around with woefully

inadequate state minimum policies that, very few claims that I see then end up in litigation

or a claim that are worth less than $15,000.

Those are the coverages that come into play if you're a passenger in a vehicle that's

involved in an accident, caused by a distracted driver.

Let me make one more point before we continue, Cindy.

Sure.

It's important to remember in this limited tort, full tort selection, it's very appealing

to get a 20% reduction in your premium.

Most people are working for every penny they get, and every penny counts.

Getting a reduction is important, but it's also important to keep in mind that if you

own a vehicle registered in Pennsylvania that's uninsured, the state punishes you.

Let me repeat that.

Punishes you, by making you a limited tort claimant.

That 20% reduction in the premium is really a swap-out for a punishment.

What Qualifies as Distracted Driving? - Duration: 3:39.

Bill, let's talk first of all about what qualifies as distracted driving.

Well, distracted driving covers anything that would keep you from remaining focused on the

task of driving.

Today, we talk an awful lot about texting, or using our cell phones when we're driving

as being distracted driving, but quite frankly changing the radio station, or just becoming

inattentive is distracted driving.

Regardless of the cause, it can have catastrophic consequences for people around you, as well

as yourself.

Yeah, it really can.

Unfortunately, I think you see that all too often.

Yeah, we do.

We see an awful lot of it.

I have several cases where, in the police report itself, the driver who's at fault is

acknowledging they were distracted by their phone, or they dropped their phone, or they

took their eyes off the road.

I have one guy admitting he was messing with his phone.

Wow.

The real problem with this, particularly with cell phone use, more so than anything else,

is that people have become so accustomed to using their cell phone, it's somewhat of an

addiction.

The accidents we begin to see are unfortunately happening at a high rate of speed, and therefore

much more catastrophic.

People are more severely injured.

Cars have gotten a lot better, they're a lot safer, so oftentimes absent some kind of quirk

in the physics of the action, of the accident, low impact accidents don't cause a lot of

harm, and the cars survive well.

But distracted drivers have a tendency to be distracted at full speed.

Flying down a highway that they're accustomed to driving on, they take their mind off the

road.

They're either looking at their phone, changing the radio or they just get tired.

Those full speed accidents can be horrible for the people involved.

Yeah.

One of the things, I was driving with somebody.

I was a passenger in a vehicle yesterday, and the driver had one of those little, you

know they have all kinds of gadgets now that'll help you prop your phone up right on your

dashboard.

I'm thinking, "I don't know that this is such a good idea."

It's almost irresponsible to sell those things because every time a text comes in, she immediately

sees it.

That can't help but distract you.

No, and it is a distraction.

You're constantly, in this day and age with the electronic devices that we have.

When I started out as a lawyer, we were still, faxing stuff was a big deal.

Email wasn't as ubiquitous as it is now, and things moved at a slower pace.

With electronics, people have an expectation, quite frankly, of immediacy, instant gratification.

The text comes in, they're actually concerned that if they don't respond timely, the person

is going to be offended.

Right.

These things are a draw away from everything that you need to be focused on when you're

driving, which is driving.

Good afternoon, and welcome to our Facebook Live broadcast today.

My name is Cindy Speaker.

I have with me as my guest attorney Bill Kenny of Berger and Green, and he's going to talk

with us today about a common topic that affects us all, distracted driving.

We're going to talk about the dangers of it, and how to protect ourselves from this difficult

situation.

Bill, thanks for being with us today.

Thanks for having me, Cindy.

Bill, this is our first Facebook Live, so what you think?

Are you a little nervous?

It's a bit peculiar.

I was telling you that I've had all kinds of things happen in this live environment,

and one day my Siri on my phone answered one of the questions.

It was crazy.

Hopefully that won't happen today, I did turn my phone off.

Well, I'd hate to have Apple replace me.

Right.

Let's see.

First of all, let's welcome our live viewers, if we have live viewers yet.

Welcome, but even we want to also welcome our replay viewers, because we find that we

get a lot of replay viewers, and we're so glad that you take the time to watch this.

We encourage you to like it, and share it if you find it's something that you think

may interest your friends or family members.

But right now, we're going to jump into the topic.

Bill, let's talk first of all about what qualifies as distracted driving.

Well, distracted driving covers anything that would keep you from remaining focused on the

task of driving.

Today, we talk an awful lot about texting, or using our cell phones when we're driving

as being distracted driving, but quite frankly changing the radio station, or just becoming

inattentive is distracted driving.

Regardless of the cause, it can have catastrophic consequences for people around you, as well

as yourself.

Yeah, it really can.

Unfortunately, I think you see that all too often.

Yeah, we do.

We see an awful lot of it.

I have several cases where, in the police report itself, the driver who's at fault is

acknowledging they were distracted by their phone, or they dropped their phone, or they

took their eyes off the road.

I have one guy admitting he was messing with his phone.

Wow.

The real problem with this, particularly with cell phone use, more so than anything else,

is that people have become so accustomed to using their cell phone, it's somewhat of an

addiction.

The accidents we begin to see are unfortunately happening at a high rate of speed, and therefore

much more catastrophic.

People are more severely injured.

Cars have gotten a lot better, they're a lot safer, so oftentimes absent some kind of quirk

in the physics of the action, of the accident, low impact accidents don't cause a lot of

harm, and the cars survive well.

But distracted drivers have a tendency to be distracted at full speed.

Flying down a highway that they're accustomed to driving on, they take their mind off the

road.

They're either looking at their phone, changing the radio or they just get tired.

Those full speed accidents can be horrible for the people involved.

Yeah.

One of the things, I was driving with somebody.

I was a passenger in a vehicle yesterday, and the driver had one of those little, you

know they have all kinds of gadgets now that'll help you prop your phone up right on your

dashboard.

I'm thinking, "I don't know that this is such a good idea."

It's almost irresponsible to sell those things because every time a text comes in, she immediately

sees it.

That can't help but distract you.

No, and it is a distraction.

You're constantly, in this day and age with the electronic devices that we have.

When I started out as a lawyer, we were still, faxing stuff was a big deal.

Email wasn't as ubiquitous as it is now, and things moved at a slower pace.

With electronics, people have an expectation, quite frankly, of immediacy, instant gratification.

The text comes in, they're actually concerned that if they don't respond timely, the person

is going to be offended.

Right.

These things are a draw away from everything that you need to be focused on when you're

driving, which is driving.

I have a 16-year-old son, just got his permit, and the thing I told him was, "Your phone

is in your pocket.

That's it."

That's good advice.

There's two rules you need to know on the road, beyond the actual rules, is that you

have to do everything you can to drive predictably, and you have to anticipate and expect everybody

about you not to be driving predictably.

When somebody is distracted, their predictability goes out the window.

They're not going to stop when they're supposed to stop, or they're not going to stay in their

lane when they're supposed to, or they're just going to swerve off the road.

They're not going to respond to the traffic conditions around them, and so responding,

and having that stuff up in front of you that is drawing your attention away from the task

at hand can be a huge problem.

It really is.

I think it was so well-stated, what you just said, and the advice that you gave your son,

I think was great.

Talk a little bit about how we can avoid being impacted by distracted driving, not only as

drivers, but also as passengers.

Sure.

As a passenger, if you're in a car with somebody, I want to disavow our viewers of the notion

that it's only young people that are texting and driving.

That's not the case.

It's not.

I drive north of the city every day on a main thoroughfare.

Lots of lights, lots of traffic, and all I have to do is look around and see all the

people returning from work, and half of them are looking at their phones while driving.

When you're in a car with somebody who's engaged in that behavior, it's in your best interest

obviously to tell them to knock it off.

They're putting you at risk, and if you're a passenger in a vehicle driven by a distracted

driver, whatever the distraction is, and that distraction leads to an accident, and you're

injured, your claim is against that driver.

Presumptively, you're in a car with a friend or an associate, and that's the last thing

you want, is to be making a claim against them for their poor judgment.

As a passenger, you need to insist that if you're going to drive, drive.

Give me your phone.

I'll read you the text, you can tell me what to text back if it's that important.

It's interesting you said that, that was another one of my questions.

So, if you're a passenger in the car, the driver has an accident, was distracted, who

pays for your injuries?

Is it that driver's insurance, your own insurance, health insurance?

How does that all work?

Sure.

In Pennsylvania, let's presume it's a Pennsylvania automobile accident, okay?

The Pennsylvania law that applies there.

Pennsylvania's a no-fault state, so you have essentially three potential levels of coverage,

automobile insurance coverage come into play.

The first is where we get the no-fault language in the act, and that first level of coverage

is called first party benefits.

It defines a minimum of $5,000 of medical benefits, really just $5,000 of health insurance,

to pay for your accident related injuries.

It comes from your own insurance coverage.

If you're in a friend's car, but you own your own car and you insured it with an insurance

company, the insurance on your vehicle, despite the fact you're in your friend's car, provides

this first level of coverage.

If for some reason you don't have your own car, or you don't live with a family that

owns vehicles, you will get that coverage from the vehicle you're occupying.

The second level of coverage that comes into play is that liability.

If your friend was distracted, and you let them get away with it, their liability coverage

is going to apply.

It's going to pay for your injuries and damages, depending first upon what kind of policy you

bought.

Let me address something that's very important here.

When you buy an automobile policy in Pennsylvania, you can select the full tort or limited tort

options.

If you select limited tort, you get a 20% reduction in your premium.

That's very appealing to people.

In exchange for that 20% reduction in your premium, you give up your right to collect

or claim an entire category of damages in any claim you make.

Under Pennsylvania law, when you're injured, you have two basic categories of damages.

You have economic loss, and you have noneconomic loss.

Economic loss is pretty easy to understand, it includes lost wages, unpaid medical bills,

medical liens.

Things that are economic in nature, we can calculate down to the penny.

Those noneconomic damages that you would be prohibited from collecting if you wear a limited

tort claim and include everything like pain and suffering, and scarring and disfigurement,

and loss of the enjoyment of life.

Let's assume in the example we're discussing that the person is a full tort claimant.

They are not prohibited from making a full claim for their damages.

You would make that full claim against a distracted driver if they were at fault for the accident.

That's interesting.

If their distraction caused the accident.

I can be a distracted driver, I can be sitting at a red light, waiting for the red light

to change, looking at my phone and get rear-ended.

I was distracted, but that distraction didn't cause the accident.

That's very different than if I'm driving down the highway, I get a text, I go to respond

to it.

I look back up, the traffic has stopped and I'm plowing into a line of traffic.

If the person is at fault, you collect against their liability coverage.

Under Pennsylvania law, unfortunately, and this has been true since the 1990s, there's

a state minimum policy of what's called a 15/30 policy.

That is, there's no more than $15,000 per person in the accident, and no more than $30,000

in the aggregate.

If there were five people in the car, all injured by this distracted driver, all five

of them would be entitled to recover no more than $30,000, and not one of them could recover

more than $15,000 individually.

It's a woefully inadequate coverage.

Wow.

The Plaintiff's BAR is working hard in the state legislature to try to increase that,

to get with the times.

I mean, when the auto law was passed, this was the state minimum, and that's over 30,

almost 40 years ago now.

Then we get to the third level of coverage, which is essentially uninsured, underinsured.

This coverage, again, comes from your own policy.

Coverage you buy to protect you in the event that the person who is at fault has one of

these state minimum policies, or has a policy that is inadequate to cover your damages.

It's called underinsured coverage.

It's also uninsured coverage, in the event, God forbid, that the person who is at fault

doesn't have any insurance at all.

That level of coverage is elective, and it's important to note that it's very inexpensive.

You should have it, because it guards you against these people driving around with woefully

inadequate state minimum policies that, very few claims that I see then end up in litigation

or a claim that are worth less than $15,000.

Those are the coverages that come into play if you're a passenger in a vehicle that's

involved in an accident, caused by a distracted driver.

Let me make one more point before we continue, Cindy.

Sure.

It's important to remember in this limited tort, full tort selection, it's very appealing

to get a 20% reduction in your premium.

Most people are working for every penny they get, and every penny counts.

Getting a reduction is important, but it's also important to keep in mind that if you

own a vehicle registered in Pennsylvania that's uninsured, the state punishes you.

Let me repeat that.

Punishes you, by making you a limited tort claimant.

That 20% reduction in the premium is really a swap-out for a punishment.

Wow, interesting.

You talked about the limited sort being about 20% less than the full tort, which based on

what you just told us, it's kind of a no-brainer decision to go with full tort.

Let me ask you also, you said that uninsured and underinsured is relatively inexpensive.

Can you give us an idea, in terms of?

We were talking, generally when I look at a policy, all policies are based upon the

risks of the insured.

Somebody with a large accident record is going to pay a premium, regardless.

I see.

But the general public, who usually have one or two accidents in their lifetime, small

fender benders, we're talking about $25 to $50 for underinsured coverage.

A 20% reduction in your premium over the lifetime of the policy on a one vehicle policy may

be 200 bucks, on a year's policy.

Maybe 400 bucks.

That's spread out over 12 months.

I think that you divide that by 12, that's not that much a month, and it's well worth

keeping in mind that you're actually taking a punishment to get that reduction.

Is that a fair trade?

It's great information.

Really, I think a lot of people, I know I always carry a full tort now, but in my younger

years, I had limited tort just because I really didn't know the difference, and I thought

if I could save the 20%.

I think a lot of people don't realize how important this decision is.

No, they don't.

It's very important.

We get a lot of calls here at Berger and Green, and the number of people that I talk to that

I say, "Do you have a limited tort or full tort policy?"

I get generic answers, "I have full coverage."

Well, that's not what I'm talking about.

I explain the limited tort and full tort, and they're dumbfounded.

And sometimes people tell me, "Yeah, I have limited tort," and they don't understand what

it meant.

Let's say they just had a soft tissue injury.

They have whiplash, and they go to physical therapy for two months or three months.

It's an interference in their life.

It's painful.

It keeps them from sleeping.

It keeps them from enjoying their life, but it's not a serious impairment of bodily function,

or as I like to tell my clients, there's no permanency to it that would warrant you being

treated as a full tort claimant even though you have limited sort.

Consequently, these people, they call and I say, "Unfortunately, given the nature of

your injuries, I don't really think that I can make a recovery that I could add value

to."

Because you can only recover your economic loss.

You can say that you've lost wages, your co-pays, your deductibles, any out of pockets, and

they'll pay you for that, except your liability.

Yeah.

Bill, who's most at risk for these distracted driving accidents?

Do you see any statistically significance in certain demographics?

No, I don't.

Across the board?

Everybody.

It's across the board.

Across the board, yeah.

Distraction is chaos, and chaos doesn't differentiate.

It will hit a school bus, and it will hit grandma turning into a parking lot to get

her weekly groceries.

It doesn't care.

No, I don't see a demographic of victims.

Now, demographically speaking, and as I alluded to earlier, you would assume that younger

people who were more "tech savvy," though I'm on Facebook Live, so give me credit for

that.

Right.

You would assume that they would be the ones more likely to be involved in causing distracted

driving accidents.

That's just not the case.

Yeah, interesting.

Statistically speaking, it's usually the people who are between 30 and 45.

How about that?

Who are causing these accidents.

How about that?

I would think that, that would be really a function of, they're not as adept.

They're not savvy with their tech.

That's right.

They are not responding as quickly.

You need to only look at my children, like I said, I have a son that's 16.

I send a text, and it could take me 10 minutes.

He sends a text, and it's a three second endeavor.

There's all sorts of factors, but it's not what you would expect.

Yeah.

Oftentimes, actually Cindy, in the cases I've seen, it's more often than not working people

who are responding to working texts that have jobs that take them out on the road, and they're

not just putting it aside and getting point A to point B. They're trying to do too many

things at one time.

Ultimately, that's the distraction.

It's taking you away from the task at hand, and exposes you and everybody on the road

to a great deal of risk.

Let me ask you this.

How is distracted driving impacting accidents in the Pittsburgh area?

What are you noticing there?

I wouldn't have anything to compare it to.

Most of my practice is in western Pennsylvania.

I see more distracted driving in the urban areas, rather than in the countries.

That makes sense.

I know what you mean.

Country folk, they're used to driving longer distances to get to things.

They're not involved in as much traffic.

I think that there's less of a tendency to think that the stop and go traffic, which

lends itself to long stop and look, then traffic picks up and you continue with that looking

despite the traffic going.

That's kind of my personal experience.

I don't have any kind of statistical analysis on that.

Bill, if someone is in an accident that involves distracted driving, what should they do?

Whether it's distracted driving, or any kind of accident, the first thing you need to do

is you need to contact a lawyer.

That sounds self serving, and I know that as a lawyer, but I'm telling you, the first

thing you need to do is contact a lawyer.

If you're listening to this broadcast, I probably told you things you weren't aware of.

It's that lack of awareness that can lead you into trouble.

The insurance company, even your own, is not necessarily on your side like some people

claim.

They're in the business of mitigating their cost, and if you don't get an attorney involved

at the outset, you can compromise your claim unwittingly, because they can be kind of sneaky

about it.

Look, the fact of the matter is this.

I have people who, three weeks after an accident, call me because they're frustrated, because

they're not getting anywhere.

They're not getting anywhere with the insurance company, or the insurance company is taking

an unreasonable stand.

I get the name of the adjuster from that person, and they retain us, and I contact that adjuster,

and the first thing out of that adjuster's mouth is, "Well, this claim is now going to

be handled by somebody else."

How about that?

Because they have adjusters for consumers, who are unrepresented, and then they have

adjusters who deal with us.

Interesting.

They can't get away with as much.

Right.

That makes sense.

After you call a lawyer, this is assuming of course you've gotten the initial medical

treatment you needed, if you're taken by ambulance from the scene.

Obviously, as soon as you're able to, contact your lawyer before you talk to any insurance

company, you are also going to go about the business of collecting what evidence you can

collect.

You want to make sure that you take any pictures of your vehicle, even take pictures of the

scene if, for instance, the dynamics of the accident are an issue.

That contemporaneous collection is really important.

Skid marks are more important than you can imagine.

It really defines the way accidents happen.

It can really lead to a conclusion about who's at fault.

Beyond that, after collecting evidence and contacting a lawyer, you retain that lawyer.

If you retain a lawyer at Berger and Green, certainly that puts you in the position of

being able to focus on your treatments, on getting better.

Focus on getting your life back on track, and the attorneys here at Berger and Green,

We're going to earn our fee because you're going to be able to put aside all the concerns

about insurance company, money, and all that sort of thing.

Let us focus on sorting it all out, and establishing exactly what it is you can or cannot recover.

These are very complex issues, they really are.

I think we see a lot of that by what you told us today.

There's a lot of complexity here.
