Judge Rules Obamacare Unconstitutional, But There's No Need To Panic - Duration: 5:50.

On Friday, a judge in Texas, a federal judge appointed by .George W Bush way back in the

day, struck down the entire affordable care act saying that everything about this legislation

is now unconstitutional, and I say now unconstitutional because that plays a big part in the ruling

which I will get to and dissect and completely debunk in just a moment, but first and foremost,

obviously people started freaking out when this happened.

You know, we've got 20 million people in the United States who stand to lose their health

insurance if this law is struck down and done away with.

So those people have absolutely every right to be concerned.

Every American has a right to be concerned right now, but I promise you it's not as bad

as you think the sky is.

In fact, not falling after this one corporate as hack Republican judge made this horrible

ruling.

So let's get into the ruling.

Technically, this ruling actually starts with a ruling from the US Supreme Court back in

2012 when they ruled that yes, the affordable care act is constitutional because Congress

has the authority to find people through the tax code.

It is part of Congress's tax powers and therefore this legislation is constitutional.

They have the authority to do that.

Last year when the Republicans passed their tax cut package, they zeroed out the tax penalty

for not having health insurance.

And that phrase is important.

They zeroed out and it's that phrase alone that this judge in Texas now said, you know

what, there's no tax penalty anymore, so it's not.

Congress is tax power.

So therefore the whole thing is unconstitutional.

If I'm basing my ruling on what the Supreme Court said was constitutional about it, that

piece is no longer there.

So it's unconstitutional.

The problem is that this judge is going to face and every other quarter along the way,

it's probably going to strike down his ruling because he's a moron.

Uh, the tax is still there.

It's still a part of the tax code.

It's just that it's zeroed out.

So the tax penalty that you pay for not having health insurance is $0, but you still have

to tell them you don't have insurance.

And then they assess a $0 penalty on you.

What this judge failed to do in the ruling, and this is why it will be struck down by

every other court because his reasoning was unsound.

He didn't count zero as a number and yes it is.

If it is still in the tax code, which it is because they didn't repeal that part of the

law and destroy it, they just reduced the penalty to zero.

The penalty still exists, therefore it is still a part of the tax powers of Congress

and therefore by the Supreme Court's own ruling still constitutional judges later on the appellate

line going to have to determine whether or not they consider zero to be a number and

it is in terms of a fine because think about it this way.

You know if you committed a crime and then the prosecutor say yes, he committed the crime.

Paul Manafort is a great example, but we're going to recommend no jail time so he doesn't

have to go to jail.

This is over for you.

Okay.

We still did the crime.

Still on your record, it still shows up.

You just pay a zero penalty.

That's the exact same situation we're looking at here with what this judge ruled.

The penalty still exists and at any given point, Congress could raise the penalty again

cause they still have that power.

They wouldn't have to draft a new amendment to the law.

They wouldn't have to change the existing Affordable Care Act, Obamacare in any way.

All they have to do is raise the tax penalty once again, and that is why what this judge

did was unconstitutional, but being a good little corporate stooge judge, as George W

dot Bush put it throughout this country, he decided to strike it down because he didn't

know any better.

Now, I hope that has east some people's fears and it would alleviate those fears.

One hundred percent had we not let Republicans pack the courts in this country for decades,

any decent non partial jurist sitting on a federal bench in this country would rule that

zero is a number.

The tax penalty does still exist even if it's zeroed out and therefore the affordable care

act has constitutional.

Unfortunately, we don't have a lot of those left.

I am.

Donald Trump has appointed almost what, 100 total judges to benches across this country

in the last two years, so yeah, it could be in trouble based on those numbers.

He's got two idiots that he's put on the Supreme Court.

That could be a problem, but if it happens that way, it's not because they looked at

it and said, yes, this is unconstitutional.

It's because these judges are proving that they are nothing more than corporate partisan

hacks who just happened to be appointed to cushy lifetime positions.

There is nothing sound about the way this judge ruled last week.

His argument does not stand.

His logic is 100 percent flawed and hopefully the judges who look at this along the appellate

line and eventually the Supreme Court agree that zero is a number and because of the tax

law, or excuse me, the affordable care act, law itself did not change.

Nothing changed about Congress's taxation power.

They just reduced the fine to zero.

Turn Wi-Fi on and off:

To turn Wi-Fi on,

swipe down from the Notification Bar

to access the Quick Settings menu,

😨 2 REAL Creepy Encounters Horror Stories Read By Strangers - Duration: 7:24.

This story took place during my freshmen year of college around spring time.

I enjoyed working out, and after a busy day, it was time to hit the campus gym.

To give you a visual of how the campus fitness center looks, the main center area has several

treadmills, some hamstring sets, and small televisions.

This area also has windows, for people outside of the gym area to peer into as well.

To the right of the treadmill area there are weights and the bench press section, to the

left is the entrance to the gym.

I was doing my nightly routine and the gym was very empty.

After I was finished, I decided that it was time to head back to my dorm.

This is when things started getting creepy.

As I left the gym and was going up the steps, I noticed someone across campus.

He seemed suspicious.

I hear him say to me, "What's up?"

This was a bearded rugged looking male, wearing a hood over his head.

I reply, "What's up" back at him.

At first, I didn't think much of it.

Maybe he wanted to be friendly?

I began to walk across the grass to my dorm, when I notice the man running towards me extremely

fast, with his eyes completely locked into mine.

I became unnerved, running back into the fitness center as fast as I could.

There is always an emplyee near the entrance of the gym who sits at a desk and has people

sign in before they work out.

At the moment, I did not tell them about what had just happened, because I felt I was possibly

being paranoid.

What if this guy just wanted to chat?

I peered outside the windows of the treadmill area, and saw shoes pacing back and forth.

I started to panic and suspected this was the same guy.

I decided to stick around and watch TV in the treadmill area for a good ten to fifteen

minutes, just to be sure the creepy man was gone.

It was obvious now that this guy did not have any good intentions.

The fitness worker at the desk asked me if everything was okay when he noticed I seemed

uneasy.

I said that someone may be following me.

They asked if I needed a walk back to my dorm, to which I replied that the guy is probably

gone by now.

I was dead wrong...

It was time.

With a deep breath and butterflies in my stomach, I braced myself and left the gym, slowly.

The weather outside was still and humid.

What came next terrified me.

As I crept up the gym entrance steps in the dark night, I hear bush rustling.

I peeked around the corner slowly, and there he was.

The same strange man leering at me with an odd, horrifying expression on his face.

He is only a few feet away now.

I started to panic.

Without a second thought, I ran back into the gym with my heart in my throat, and told

the worker that someone was right outside the gym, stalking me.

Campus security was then called.

However, by the time security got there, the man was nowhere to be found.

I thought the guy wanted to be friendly, but clearly he was up to no good.

Thinking about the situation still gives me chills to this day.

I worked as a flight attendant for a few years, when I decided to take some time off from

college.

There were a handful of uncomfortable situations I encountered during that time, but this one

in particular still makes my skin crawl.

I was born and raised in Texas but had moved to New York when I was 21, so when I found

out at the beginning of a weeklong trip that I'd have a couple of overnights in Austin,

I was super excited to go to my homestate for a few days.

My brother lived just north of the city and we planned to hang out and go to dinner, and

the following day we were going to meet up with our dad who lived about an hour away.

I get to the hotel downtown, the crew and I check in, and then we each head off to our

rooms.

After a short elevator ride I get to mine.

Not even five minutes later there's a loud, hard knock on the door.

It was only around 1 or 2pm and I hadn't called either my dad or brother to let them

know I was in town yet, so that could not be them.

I assumed it was maybe one of my crewmates, so I headed to the door.

Before even making it to the door, I hear a loud, male voice on the other side

"The front desk sent me about the bathroom problem you called in,"

He tries to open the door.

"Unlock the door and open up, Miss.

I need to come in, now."

I froze in my tracks.

I hadn't even been in the bathroom yet, let alone called the front desk.

I slowly inch towards the door to look out the peephole.

All I could tell was that the man on the other side was at least 6ft tall, and easily over

double my weight.

No way in hell was I going to unlock the door.

I responded to the guy, telling him he must have had the wrong room.

He continued pounding on the door while constantly turning the handle, telling me he needed to

get in and was getting inside one way or another.

I panicked, but thankfully had the sense to grab the phone and call the front desk.

The concierge confirmed that they had neither sent anyone up to my room nor had they received

a call about the bathroom.

The entire time, this scary guy was determined to get in my room, pounding and yelling.

Luckily, the front desk had dispatched security to my floor.

I can hear security stepping out of the elevator, approaching the guy, asking him who he was,

what he was doing, and telling him he needed to leave the hotel.

He immediately got hostile and aggressive toward them, and the front desk clerk I'm

still on the phone with, tells me police have been called and are on their way.

This entire time I'm trapped in my room, scared shitless.

The cops show up pretty quickly and manage to arrest the guy for trespassing.

I later found out that the guy was wanted in connection to a string of break-ins and

violent sexual assaults in Austin.

He had seen and stalked me from the minute I entered the hotel lobby.

Apparently I was exactly his "type" of victim.

I still think every now and then whant could have happened if I opened the door..
