A federal judge refused to dismiss a lawsuit against Facebook, which accuses the company

of harvesting biometric facial data without consent.

As a result, the company's gonna face trial.

Facial recognition is one of the most used technologies derived from artificial intelligence

to date.

And while many companies praise its benefits, many in the public clearly don't see it that

way.

Joining me now to talk about this is correspondent Brigida Santos.

Brigida, what was the problem with Facebook's use of facial recognition initially and why

did they try to have the case dismissed.

I mean, it's pretty obvious.

I mean, you don't just take somebody's image and use it without any kind of permission.

I mean if you did that to, say a celebrity, you're going to ... you get paid for using

that image.

But it's a right to privacy issue that I just think is the very outside of crazy in this

particular case.

What's your take?

My plaintiffs from three consolidated class-action lawsuits in Illinois have accused Facebook

of violating the Illinois Biometric Information Privacy Act, which does require companies

to obtain consent before collecting, analyzing and disclosing biometric information.

Now, Facebook had tried to argue that these people could not sue them in federal court

unless they could prove that they had suffered actual damage.

But the judge, as you said, has rejected Facebook's arguments here on behalf of the people, saying

that Facebook did cause intangible harm by denying people the right to control this private

information.

So they are moving forward with a trial and these plaintiffs are also seeking damages

for Facebook's use of their private information in order to build that technology in the first

place, which it is going to be profiting from, Mike.

Yeah, let's be clear about this.

Facebook didn't do this so Facebook could get better.

Facebook did this so they could take this information, sell it to other people, to where

when you go on your computer you're going to be bombarded by everybody in the world

trying to sell you something.

And there's something now, when you add the facial recognition aspect of that, Facebook

understands that ups the anty, they make more money when they sell your private information

to other people.

There's nothing noble about this.

This is not something even necessary that Facebook needs.

Look, reports say Facebook is actively lobbying to prevent or remove any existing regulations

against its technology.

What exactly are they doing to achieve that?

This lawsuit was first filed in 2015.

A year later in 2016 Facebook spent over 670,000 dollars in Illinois on special interest groups

that have lobbied the state lawmakers not to pass regulations on this specific technology.

Now on a federal level The Center For Responsive Politics has found that in 2016, that same

year, Facebook spent 8.7 million dollars lobbying federal lawmakers not to regulate this technology.

And these efforts are working.

At least five states have tried to pass similar ones to the one in Illinois, which would regulate

this technology and unfortunately all but one have failed, Mike.

Yeah, one of the inventors, this is interesting ... The very people that inventing this facial

recognition says that the technology is being horribly abused.

What does he mean by that as far as you can tell?

What are his concerns and how are they being used.

I mean, if you really, as I say, follow this.

Facebook is trying to make it into some type of noble constitutional right.

They're trying to say, "Gee, were doing this to better our business."

But that's really not the case when the inventor says, "Look, come on.

It's being misused.

You know what's happening here.

We're not idiots.

You're taking this and you're making more money."

What is your take on that?

Joseph Atick, who is one of the people who helped create this in the 1990's, this biometric

data collection, he says that he's very troubled by the fact that it's being used to identify

people in public, again without their knowledge or consent.

And the fact that this information is then being sold off, Mike.

The ACLU claims that facial recognition, obviously ... I mean, we don't need them to tell us

that, but they point out how it's a tool for kind of surveillance by, kind of police surveillance.

But not just police surveillance, surveillance by people wanting to sell you something.

Surveillance by people wanting to get into your life someway.

So it's just not a authoritarian kinda surveillance that we're worried about.

It's all these other parts.

Isn't that claim pretty obvious to you that it's not just ... We're not just worried about

police.

We're worried about an entire social structure, cultural structure getting into our lives

to mess with us.

Selling us stuff, hacking us, whatever it is.

The more this information is out there, the more we're in danger.

What do you think?

Yeah, it's absolutely an authoritarian tool or it could be used as one.

It erodes civil rights.

Police agencies around the country are already using other types of social media tracking

tools to locate and identify protestors at events.

So this could be used in the future to curb free speech, to intimidate people into behaving

in certain ways and complying in certain ways.

And it could also be used to target people in communities of color or immigrants.

There are a lot of ways that this technology can be misused, Mike.

Yeah, besides the law in Illinois, obviously there's federal laws at some federal level

that we could regulate Facebook somewhat.

But state by state, states can pass laws like this.

I mean we could have this in every state where Facebook can be spanked for doing this type

of thing.

Are any other states getting involved in what Illinois is doing?

It's so logical.

It's just so good for consumers to have this kind of protection.

What's your take?

Mike, right now at least five states, as I said, have tried to pass similar laws to the

one in Illinois and so far only Washington state has been successful.

And on the federal level right now, there are no laws regulating this technology, Mike.

Well, we got a big road ahead of us.

But if state by state they would go after Facebook on this, I think we can at least

stop it.

We might be able to step in where the feds typically are unwilling to step in.

MS 13 - The Newest Murder Inc. - Duration: 3:22.

A New York mother is suing a school district for failing to protect her daughter from being

brutally murdered by the MS 13 gang.

Gang members were harassing this girl for almost two years before they killed her.

The school district is well aware of this problem the whole time and they apparently

did nothing to defend this young girl's life.

Joining me to talk about this is Mollye Barrows, Legal Journalist for Trial Lawyer magazine.

This is not just an isolated story.

We're hearing this more and more.

It all centers around MS 13, especially that part of the story.

Yes.

Tell me, aside from the obvious, and that is the folks at the school failed to do their

job, how has MS 13 become such an impact at so many of these schools?

It's really interesting.

Apparently it stems back 2013, the office of refugee settlement, so it's apparently

a resettlement is what they call it.

They're having thousands of these unaccompanied minors come through the Mexican border, predominantly

from Central America.

It is through that government office they're being placed.

A lot of these kids are turning themselves into authorities so the government office

places them some 5,000 of these unaccompanied minors were relocated in Suffolk County where

Brentwood High School is where this young woman was killed and her best friend was also

killed as well.

Kayla Cuevas is the 16 year old that was beaten to death in September of 2016.

It's her mother who is filing this lawsuit.

It's a federal lawsuit for $110 million basically saying, as you said, this bullying had been

going on, she'd been repeatedly threatened and nobody had done anything to protect her

until one day she and her best friend were walking home from school, they disappeared,

their bodies were found beaten.

They'd been attacked with a machete.

There had been five murders of students at Brentwood High School and they even picked

up some kids that were on their way to go kill another student.

The kids that were picked up were from the MS 13 gang.

Essentially they said, "Yes, we were going to go kill this kid basically because they

ticked us off."

Two of the kids that were in that group attended the school as well so basically you have gang

members within the school and they have this Central American background and sometimes

they're targeting other students because they come from a different Hispanic background

or they just are simply running wild and looking for any excuse to commit violence is what

police are saying.

It does go back to some immigration concerns that the Trump administration has brought

up.

If you think about it, ICE is getting sessions and ICE is under all this criticism for going

after the MS 13 gang.

I don't quite get that criticism, but I do understand what's happening here is you have

MS 13, these unaccompanied minors, they don't have parents, they don't have any family coming

into the country.

What ends up happening is MS 13 says, "We're your family."

That's right.

They bring these kids in and of course they pray on their insecurities as so often happens

in these gang violent situations.

What is so tragic about this is that the school really is left dealing with this huge influx

of students.

They've had to hire more teachers, deal with all this violence that's occurring within

school grounds.

The mother said she and her daughter had gone to the school district as well and said, "Listen,

my daughter's experiencing these threats, all these terrible things are happening to

her."

They said, "We're going to ..." especially from one particular student, they said, "We're

going to get rid of that student."

The child had even pulled a knife on her but they never did take that student out of the

school.

Vince Staples Did Something Charitable With GoFundMe Donations - Duration: 1:29.

Last week, Vince Staples pulled off a brilliant troll on his haters.

Staples not-entirely-seriously started a GoFundMe dubbed 'Get the F*ck Off My Dick' where he

was trying to raise 2 million dollars.

He explained why:

"On GoFundMe.com, you can decide to donate to the cause of $2 million dollars, which

will allow me to shut the f*ck up forever and you will never hear from me again.

No songs, no interviews, no anything.

If not, you can choose to let me do what the f*ck I want to do, when I want to do it.

Get off of my dick, or fund my lifestyle.

The choice is yours.

Either way, we appreciate you."

Vince ended up doing one better by releasing a song aimed squarely at his critics titled,

you guessed it, "Get Off My Dick," but he had one more trick up his sleeve.

After the GoFundMe raised $2,022, Vince decided to shut it down and return the money to his

loud minority of haters.

He took to Twitter to explain why he shut it down.

"Seeing as we clearly won't reach our goal of 2 million dollars, I am cancelling

the gofundme and refunding all the little people with big voices.

I expect to hear no further slander.

I am also personally matching the donations made and donating the full amount to the Michelle

Obama library of Norf Long Beach... in honor of you citch ass n*ggas.

I love you all, good day."

That's right: Vince put his money where his mouth was and gave back to his community.

Hopefully this means that people know that he truly isn't tripping off of peoples'

negative comments.

We also hope this means Vince has some new music on the horizon.

Props to Vince to doing right by his people with this hilarious troll move.

Tina Lawson's Husband Joins Cast Of New Legal Drama, 'In Contempt' | In Contempt - Duration: 5:31.

- I'm Erica Ash and you are on the set of "In Contempt",

the new show on BET.

- I'm playing Gwen Sullivan.

She is a public defender and this is a one hour law drama

and it's interesting because generally when you see

law dramas, they are on the other side,

the District Attorney side and so they're always going

after the bad guys.

But I think what's interesting about this show is that

it shows the other side of things and my character

fiercely fights for everyone that she represents

and that's why I really, really like Gwen.

She's ballsy and slightly crazy.

Fun in it for me, it's like a mystery novel that I get to

be right in the middle of and I get to be a part of it

unfolding, and you know, the whodunnit, and how are we

gonna prove it?

And, unlike, you know, find the sleuth.

Bennett Thompson, Bennett Thompson is my dream guy.

He's smart, he's sexy, he's everything that a woman

would want a man to be: charming, successful.

Did I say smart and sexy?

- My name is Tobias Truvillion and I play the character,

Bennett Thompson.

You're really getting down to the essence of, I would say

Gwen and Bennett's relationship, you know, we're starting

to really pull back some layers.

You know, we really get to see who they are as individuals,

we really get a chance to see how they are together,

you know, through love, through trust, through trust issues,

through friendship, and then we really get a chance

to really see how there's some potential

for their relationship.

- I am Megan Hutchings and I play Tracy Campbell and

Tracy is a sassy, bold lawyer from the south who might

have some secrets of her own.

Well, Gwen is my best friend and my roommate, but also,

I'd say Gwen is extremely dedicated and passionate

about what she does.

She is messy as fuck, and all she does is eat junk food

and drink flame bolts and doesn't pay her bills on time

so I'm constantly covering her half of the bills.

But I love her so I do it.

- I am Christian Keyes, I play Charlie Riggs

on In Contempt.

I'm a public defender.

My character is serious and good at his job, at my job,

but also don't take everything very seriously.

Charlie is definitely adept at his job, functional,

knowledgeable, good-hearted person, but you know,

he plays a lot.

Bit of a ladies man, has a history with the Gwen character,

played by the wonderful and incredibly funny and goofy

Erica Ash.

And we have a romantic history and an occasional romantic

run-in.

(rolls tongue)

Gwen's characterization of Earl, her father.

She doesn't like the fact that

he doesn't love her job choice.

- So I'm Earl Sullivan, retired judge, and having had a

distinguished career, I'm trying to get my daughter to

see the light, that she could fight for the people that

she's interested in fighting for, better,

from a higher perch.

She's against it, trying to win these battles in the

court system with not enough money and not enough time,

and that if she worked for a larger firm or a corporate firm

she could have better gloves to fight with.

Gwen is such a headstrong person, brilliant lawyer,

but she's fighting from a level that she cannot win,

and there's always gonna be a life of frustration

and dissatisfaction for her because, the fact that she's

gonna lose most of those battles, and I'm really constantly

trying to convince her that she can fight this

in a better way.

I feel so frustrated by her experience and I want to

see her have a better life and not have to work so hard

and I think people will be able to look at this show

and really see the world around them.

- I think that it's very, very important that people

see this, especially in the climate today, with all of

the things that are going on and the way that people

are getting off, especially a lot of police officers

who are getting off after doing very heinous things,

especially to young black men.

I think it's going to be very interesting to see the

cogs and innerworkings of how the justice system would

allow something like that to happen.

You're going to be able to see the loopholes and how

people can shimmy through them and you're gonna be able

to see how people work together.

You're going to be able to see the disadvantages that

we start off with going into the courtroom and why

it's so important.
